and one half (2.5) trips per standard eight (8) hour business day and twenty (20) vehicle trips within a twenty-four (24) hour period since it is located along a County State Aid Highway. The City has received a number of ordinance complaints regarding this business. The complaints are attached for City Council review. These complaints appear to be related largely to noise of the vehicles and light glare produced by the headlights of the commercial vehicles. The City Council could consider additional screening, requiring temporary shut -offs of back-up alarms in accordance with Minnesota Department of Transportation standards, or limiting hours of the operation. Recommendation: Planning Commission 'met on August 6, 2009 to hold a Public Hearing for a request for a home occupation permit and recommended approval of the home occupation permit, contingent upon the Applicant upgrading the proposed parking area to class V, concrete or bituminous as stated in section 9.11.08 of the City Code with both vehicles being parked even or behind the principal dwelling. Funding Source: The Applicant is responsible for all costs associated with processing the application for a home occupation permit. Council Action: Motion to adopt Resolution #09-08-i, adopting Findings of Fact # relating to the Applicant's request for a home occupation permit. -and- Motion to adopt Resolution #09-08-_, approving the Applicant's request for a home occupation permit based on the findings of fact. -or- Motion to deny the request for a home occupation permit based on the findings of fact.
