Attachment C <br />Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #09-08- <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FROM DAVIT? AND JEAN HAUAN FOR A HOME OCCUPATION PERMIT <br />TO OPERATE A SEPTIC REPAIR AND MAINTENANCE AND GENERAL <br />EXCAVATION BUSINESS ON THE PROPERTY LOCATED AT 16341 JARVIS <br />STREET NW. <br />WHEREAS, the City of Ramsey received an application from David and Jean Hauan <br />requesting a home occupation permit to operate a septic repair and maintenance and general <br />excavation business in a principle dwelling unit and accessory structure located on the property <br />generally known as 16341 Jarvis Street NW and legally described as follows: <br />Lot 1, Block 1, Weaver Addition, Anoka. County, Mimlesota, subject to easement of <br />record. <br />(the "Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br />That on June 12, 2009, David and Jean Hauan, hereinafter referred to as "Applicant", <br />properly applied for a principle dwelling and accessory structure home occupation permit <br />(the "Permit") to operate a septic repair and maintenance and general excavation business <br />on the Subject Property. <br />2. That businesses operating with outside storage and commercial vehicles and equipment <br />not screened on all sides or other exterior signs in the R-1 Residential District require the <br />issuance of a home occupation permit. <br />That on June 16, 2008, the City Council adopted a home occupation ordinance allowing <br />residents the ability to apply for a home occupation permit to operate a business within an <br />accessory structure and employ non-resident employees as outlined in the home <br />occupation ordinance. <br />4. That the Applicant has stated that the business has been operating for several years on <br />the Subject Property. <br />5. That the Applicant appeared before the Ramsey Planning Commission for a public <br />hearing pursuant to Section 9.03.05 of the City Code on August 6, 2009, and that said <br />public hearing was properly advertised. <br />6. That the Subject Property is zoned R-1 Residential — Rural Developing, and the parcels <br />to the North and South are also zoned R-1 Residential — Rural Developing; the property <br />to the East is zoned Planned Unit Development (Northfork); the property to the West is <br />Industrial and Single Family, it is outside the City Limits. <br />7. That the Subject Property is approximately 5.63 acres. <br />
