C CASE 9 1 <br />REQUEST FOR AY, EXTENSION TO 60 DAY RULE FOR SITE PLAN REVIEW AND <br />ZONING AMENDMENT FOR SENIOR ASSISTED LIVING COMPLEX IN THE <br />RIVERS BEND ADDITION; <br />CASE OF RIVERSIDE COMPANIES <br />By: Tim Gladhill, Associate Planner <br />Background: <br />On May 4"', 2009, the City received an application from Riverside Companies to develop a 46 - <br />unit apartment building on the property, generally located on Xkimo Street, south of 142nd <br />Avenue adjacent to River's Bend Park. <br />Notification: <br />Site Plans do not require a public hearing, but the City attempted to notify property owners <br />within 350 feet of the subject property as part of the proposed zoning amendment. No <br />notification was made for the extension request. <br />Observations: <br />Comforts of Home has submitted a site plan, on behalf of Riverside Companies application to <br />develop a 46 -unit, assisted living/memory care apartment building on an existing property <br />located adjacent to River's Bend Park. The property is approximately 6 acres in size and is zoned <br />R-3 High Density housing. The property was rezoned in 2003 as part of the Comprehensive Plan <br />process. The Applicant is requesting a zoning amendment to Planned Unit Development (PUD) <br />in order to reduce the parking requirements while providing permanent protection of the sensitive <br />natural resources in the area. The land use will remain .high density residential in the <br />Comprehensive Plan. <br />The City Council may recall, the City executed a purchase agreement with Riverside Companies <br />(Rick Foster) on the property adjacent to River's Bend Park. Riverside Companies had been <br />working with Comforts of Home on a Site Plan for the parcel. Comforts of Home has decided to <br />pursue a location other -than the River's Bend location, and has withdrawn their'request for Site <br />Plan Review. Riverside Companies would like to continue with the current review, with a <br />different developer. <br />Staff feels it is appropriate to approve the request for extension. Riverside Companies has shown <br />effort to accommodate protection of the river bluff and provide significant open space to help <br />serve as density transitioning to the single family neighborhood through the PUD process.. <br />In order for the Application to be transferred to Riverside Companies officially, the remaining <br />balance of the escrow will need to be refunded to Comforts of Home. Riverside Companies will <br />then need to replenish the escrow to continue moving forward with the review. <br />
