<br />" <br /> <br />Attachment E <br /> <br />Councilmemb~r <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #09-09-_ <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT, <br />TO EXCEED THE TOTAL AMOUNT OF ACCESSORY STRUCTURE SQUARE <br />FOOTAGE BASED ON FINDINGS OF FACT #_ AND DECLA.RING TERMS OF <br />PERMIT <br /> <br />WHEREAS, on October 22, 2008, Robert D. and Alma J. Teigen, husband and wife, (the <br />"Permittee"), properly applied for a conditional use permit for. an overage in total accessory <br />building square footage established in City Code Section 9.11.02 on the property generally <br />known as 7833 159th Ln NW and legally described as follows: <br /> <br />Lot 11, Block 1, Sortebergs Addition, Anoka County, Minnesota <br /> <br />("Subject Property"); and, <br /> <br />WHEREAS, the Planning Commission met on September 3, 2009 and conducted the <br />public hearing and recommended City COuncil approval of the request. <br /> <br />. NOW THEREFORE BE IT RESOL YED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That hased on Findings of Fact # _, a conditional use permit (the "Permit") to <br />construct a 576 square foot accessory structure expansion to the existing garage, (the <br />"Structure"), which will result in exceeding the total amount square footage allowed by <br />no more than 151 square feet on the Subject Property is hereby granted to the Permittee <br />as, shown on the Site Plan prepared by the Applicant herein attached as Exhibit A. <br /> <br />2. That the Structure shall conform to all other requirements for accessory structures. <br /> <br />3. That the Permittee shall obtain all necessary permits, including but not limited to <br />building permits, prior to commencing any construction of the Structure. <br /> <br />4. That no commercial or industrial activity of any type shall be permitted on the Subject <br />Property unless the necessary permits have been obtained from the City per City Code <br />Section 9.11.04 (Home Occupations). <br /> <br />5. That any repairs to fuel systems, electrical systems or repairs using open flame or welding <br />shall be prohibited in the Structure. <br /> <br />6.
