<br />CASE # I <br /> <br />Public Hearing <br />REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED THE TOTAL AMOUNT OF <br />ACCESSORY STRUCTURE SQUARE FOOTAGE AT 7833 lS9TH LN NW: <br />CASE OF ROBERT TEIGEN <br />. By: Tim Gladhill, Associate Planner <br /> <br />Background: <br /> <br />On July 15, 2009, the City received a request fmm Robert Teigen for conditional use permit (CUP) to <br />exceed the amount of square footage allowed for accessory structures located at 7833 159th Ln NW. <br /> <br />Notification: <br /> <br />In accordance with City Code, Staff attempted !o notify property owners within 350 feet of the property <br />via standard US Mail. <br /> <br />Observations: <br /> <br />The applicant is requesting a CUP to allow for the construction of an approximately 576 square-foot <br />accessory structure expansion to the existing attached garage. At this time, the subject property has a <br />576 square foot attached garage, a 1,440 square foot detached accessory structure, and a 259 square foot <br />detached accessory structure for a total of 2,275 square feet of accessory space. If the overage of <br />accessory structure space were to be approved, the total amount of accessory structure square footage <br />would be 2,851 square feet. This would equate to a total of a 15i square foot overage to the allowed <br />2,700 square feet. <br /> <br />However, the Applicant is proposing to remove the existing 259 square foot accessory structure upon <br />completion of the expansion, which would bring the total square footage to 2,579 square feet, within <br />compliance of City Code. Given this fact, Staff would recommend amending the request to an interim <br />use, which better addresses the request of the Applicant. In line with past policy to ensure the existing <br />structure is removed per the terms of the permit, Staff would reconimend collecting an escrow of $2,000 <br />held until the structure is removed, contingent on agreement of the Applican~ if the request is amended to <br />an interim use permit. Otherwise, the request could remain a conditional use, which would run in <br />perpetuity with the parcel so long as the terms of the permit within are complied with. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the request, contingent on amending the request to an interim use and <br />collection of an additional $2,000 escrow to ensure removal of the existing structure. <br /> <br />Commission Action: <br /> <br />Motion to recommend that City Council adopt Findings of Fact relating to the applicant's request for a <br />conditional use permit; <br /> <br />-and- <br /> <br />1 <br />
