there were any lodged previously, as there is a new code enforcement system in place and now
the City has a better way of tracking.

Commissioner Cleveland asked what is being done with the disposal of the hazardous waste
material on the property from the business.

Associate Planner Gladhill stated that staff has not been on the property to do an inspection since
the . business has been terminated. Staff has held up on doing an inspection until the home
occupation permit process is completed. The applicants are well aware that there should not be
any hazardous materials on the property. If staff becomes aware that there are hazardous
materials on the property they can contact Anoka County Environmental Services as well as the
Fire Inspector to get those materials removed.

Chairperson Levine questioned if there were other people doing auto repair out of their homes.

Associate Planner Gladhill stated there have been two or three complaints of this nature. They
received the same notice and illformed us they are no longer doing this type of business. They
have complied with the regulations and terminated the activity and are not coming forward with a
Home Occupation Permit application.

Commissioner VanScoy questioned what the language was in the ordinance regarding this type
of business.

Planning Manager Miller read the ordinance.

Commissioner VanScoy asked what the welding equipment will be used for.

Mr. Loginov explained his usage of the equipment; that it would be small welding and that 110
power would be used.

Motion by Commissioner Van Scoy, seconded by Commissioner Cleveland, to close the public
hearing.

Motion Carried. Voting Yes: Chairperson Levine, Commissioners, Van Scoy, Cleveland,
Dunaway, Hunt, and Rogers. Voting No: None. Absent: None.

The public hearing closed at 7:37 p.m.

Commission Business

..
Commissioner Rogers has concern of future complaints from neighbors and what the threshold
should be to continue allowing the business.

Commissioner Dunaway has no problem with people working. on their own vehicles, but a
vehicle repair business in the residential. area would not be a conducive use for an owner's
property.

Planning Commission/August 6, 2009

P3
