<br />Public Hearin!! <br /> <br />Chairperson Levine called the public hearing to order at 10:22 p.m. <br /> <br />Presentation <br /> <br />Planning Manager Miller presented the Staff Report. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Chairperson Levine, seconded by Commissioner Cleveland, to close the public <br />hearing. . <br /> <br />Motion Carried. Voting Yes: Chairperson Levine, Commissioners, Cleveland, Dunaway, Hunt, <br />Rogers, and Van Scoy. Voting No: None. Absent: None. <br /> <br />The public hearing closed at 10:30 p.m. <br /> <br />Commission Business <br /> <br />Commissioner Dunaway stated. in reviewing the staff report and the permitted uses he found it <br />hard to believe that with this revision motor vehicle sales would need a conditional use permit, <br />.but adult type uses are permitted without going through that process. I was informed that there <br />are state statues that protect one business over another. He continued that driving down Highway <br /># 1 0 there are some very fIne auto dealers that have a nice looking business, and there are others <br />who put vehicles on unimproved surface and shouldn't have that number of vehicles that they <br />have. He is in favor of this revision. <br /> <br />Commissioner VanScoy asked if the thought was that there were too many dealerships on <br />Highway # 10 or what is the intent of the revision. <br /> <br />Planning Manager Miller stated that was part of the discussion. Some of the parcels are smaller <br />and cannot meet the setbacks, so the use. is lawful non-conforming. Once a use is ceased for a <br />year this revision would give the City the opportunity to decide if it wanted to continue this <br />particular use. To address the use with existing establishments, Council has the option of <br />utilizing code enforcement. <br /> <br />Commissioner Cleveland stated that advantages of the Conditional Use Permit are that it would <br />give the opportunity to require more aesthetics, landscaping and enforce some changes. <br /> <br />Planning Manager Miller stated it allows the Planning Commission and City Council to perhaps <br />add additional requirements or decide the sight is not appropriate for the use any longer if the <br />sight is too small and does not have ample display area. <br /> <br />Planning Commission/August 6, 2009 <br />Page 10 of 12 <br /> <br />P10 <br />
