<br />Motion by Mayor Ramsey, seconded by Councilmember Elvig, to Adopt Ordin~ce No. 09-11 <br />declaring Lot 3, Block 1, Sunfish Lake Business Park Third Addition as surplus property and <br />authorizing its sale. <br /> <br />A Roll Call vote was performed by the Recording Secretary. <br /> <br />Councilmember Dehen <br />Councilmember Elvig <br />Councilmember Wise <br />Councilmember Jeffrey <br />Councilmember McGlone <br />Councilmmember.Look <br />Mayor Ramsey <br /> <br />aye <br />aye <br />aye <br />aye <br />aye <br />aye <br />aye <br /> <br />Motion carried. <br /> <br />Case #4: <br /> <br />Adopt Resolution #09-07-XXX Ratifying Change Order No. 1 for <br />Improvement Project #08-27, Water Tower #3. <br /> <br />City Engineer Himmer reviewed the staff report. <br /> <br />Councilmember Wise questioned what the contingency is in the original bid. <br /> <br />City Engineer Himmer explained that the bid came in well under estimated cost and there was no <br />. contingency budgeted. <br /> <br />Councilmember, Look was., not opposed to moving the tower but was concerned with the <br />possibility that Highway 47 may eventually expand, and how the City could liquidate the <br />property originally purchased. He understood that work was underway but wanted to ensure that <br />a master plan had been developed for the area, and what could be done around it, on the City <br />owned property. <br /> <br />City Engineer Himmer stated that any future development would require ponding and that could <br />be provided on this site by reconfiguring the pond to fit ultimate development, or by requiring <br />the developers to pay into the ponding as development occurs. <br /> <br />Councilmember Dehen understood that the request to move the tower was being requested <br />because of the amount of clay and questioned why that was not determined from the soil borings. <br />He was concerned that clay could be found in the new location as well, and questioned what <br />would -be done if that were to occur. <br /> <br />City Engineer Himmer explained that the soil borings had been done in the new proposed <br />location and no corrections would need to be done in excess of the amount stated. <br /> <br />City Council / July 28, 2009 <br />Page 10 of 13 <br /> <br />P22 <br />
