<br />Attachment D <br /> <br />Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-08-200 <br /> <br />A RESOLUTION DECLARING TERMS OF VARIANCE TO THE MINIMUM LOT <br />WIDTH, LOT AREA, AND ORDINARY HIGH WATER SETBACK IN THE CRITICAL <br />RIVER QVERLA Y DISTRICT. <br /> <br />WHEREASt on August 5, 2004, the Ramsey Board of Adjustment issued a variance <br />from Section 9, 21.07 of the Ramsey City Code to permit the construction of a dwelling unit on <br />the properties legally described as follows: <br /> <br />Lot 5 and Lot 6 Bowers Mississippi Acres, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact #0689, a variance to lot width, lot area, and structure setback from <br />ordinary high water mark is hereby granted in order to construct' a dwelling on the Subject <br />Properties. <br /> <br />2. That Lot 5 and 6 will be .63 and .57 in size respe~tively, and 100 feet in width. <br /> <br />3. That Lot 6 shall not be eligible for a building permit unless the existing homestead located on <br />Lot 5 is demolished or relocated on the Subject Property in a maImer that complies with the <br />setbacks established in Ci~ Code and the approved variance. <br /> <br />4. That Lot 6 will be eligible for a building permit as such time as Anoka County has assigned a <br />separate Parcel Identification Number (PIN). <br /> <br />?/{ <br /> <br />5. That the dwelling units constructed on Lot 5 and 6 shall not be 10cated any closer than 138 <br />feet from the ordinary high water mark of the Mississippi River. <br /> <br />6. That the Applicant is responsible for obtaining any other regulatory permits required for the <br />demolition of the existing homestead located on Lot 5. <br /> <br />7, That the dwelling units constructed on the Subject Properties shall not exceed 35 feet in <br />height. <br /> <br />*' 8. <br /> <br />That no other structures or additions shall be constructed in the reduced river setback, except <br />that there shall be an exception to the structure setback that shall allow encroachment of an <br />open deck up to ten (10) feet into the setback area. <br /> <br />9. That the Applicant is subject to the Building Permit process and must comply with all <br />International Building Code requirements when constructing the new dwelling units. The <br />City will require a certified drain field report for both lots. <br /> <br />7 <br />
