<br />Mayor Ramsey responded that Representative Abeler initially signed onto this bill only to be <br />able to have input on it but since then he has gotten himself off this bill. Mayor Ramsey also <br />stated that Senator Jungbauer believes this bill gives more flexibility for some communities. <br /> <br />Councilmember Look explained at the meeting the previous night there was a hearing on this bill <br />and there were significant language changes to this bill. The way it stands, he thinks, based on <br />these portions of the resolution, that given any of these whereas' if they are included in any bill <br />that goes forward it is potentially detriment. r <br /> <br />Councilmember McGlone wanted to bring up the point that if the tax base along the river goes <br />up, the entire City has an impact and if non-conforming homes is determined and given a <br />situation there is a fire they are not going to allow you to rebuild and there goes tax base. <br /> <br />Mayor Ramsey stated this has been clarified that the structure would be allowed to be rebuilt <br />even if this is non-conforming. <br /> <br />Associate Planner Gladhill wanted to distinguish between lawful non-conforming and non-lawful <br />non-conforming. If this was to go through, many of these would become lawful non-conforming <br />and an expansion would require either a variance or some sort of special use permit. As it is <br />written today these would have to be certified by the Commission of the Department of Natural <br />Resources per our local zoning ordinances. Therefore, there are some implications whether it is <br />lawful non-conforming or non-lawful non-conforming. <br /> <br />Mayor Ramsey asked if staff had done any research on this. <br /> <br />Associate Planner Gladhill responded that City staff has done some research. What they have <br />seen in the early stages is a lot of discussion through the MN American Planning Association and <br />he thinks the intent was to merge two sections where there was some duplication in regulation. <br />Whether it be setbacks or lot coverage in the forms of critical river and the shoreland that deal <br />with different areas or whether it be the river or some of the DNR designated lakes, ponds or <br />wetlands. What they originally wanted to do was to merge those into one section of either the <br />house bill or with our local ordinances too. They have also heard as well that maybe it does put <br />too much authority within the DNR but there are still more administrative things for them to <br />research <br /> <br />Mayor Ramsey feels this is a resolution to send a message to the legislator that we are not in <br />. favor of this type of legislation in this current form and basically sending a message that our <br />opinion is this is not good for the City of Ramsey. <br /> <br />Motion by Councilmember Look, seconded by Councilmember McGlone to adopt Resolution <br />#09-04-081 Opposing HF 1973 in the City of Ramsey. <br /> <br />Motion carried: V oting Yes: Mayor Ramsey, Councilmembers Look, McGone, Jeffrey, Wise. <br />Voting No: None.
