<br />Mayor Ramsey stated he is opposed to a city forcing its way into a tenant-occupied home to do <br />an inspection; if a person is leasing the property and does not want an inspection, they should not <br />have to let the city on to the property. He felt the City could offer the inspection service to any <br />tenant that wanted it, but not mandate it. <br /> <br />Councilmember McGlone stated he was told that a landlord cannot enforce a tenant's duty to pay <br />rent, regardless of whether it is written into the lease or not. He stated the statute states if the <br />tenant finds anything wrong, the landlord cannot enforce the tenant's duty to pay rent. <br /> <br />Councilmember Look noted that the Constitution protects people against unreasonable search <br />and seizure and the City cannot inspect a property for safe or unsafe conditions if a tenant does <br />not want their property inspected.
