CASE#~

INDEMNIFICATION OF PROPERTY OWNER INSTALLED SEPTIC SYSTEMS
By: Steven Jankowski, Assistant City Engineer

Background:

Section 8.30.03(c) of City Code allows the installation of septic systems by the property owner
provided that the City received an indemnification from that property owner. Anoka County has
an ordinance that prohibits the installation of septic systems by anyone without an installer's
license. Copies of both the City Code and the County ordinance are attached to this case. Staff
understands that in a conflict such as this, Anoka County has primacy over this city and that the
City cannot be less restrictive than the County.

Recommendation:

Staff recommends that Section 8.30.03(c) be repealed to come into conformance with Anoka
County ordinances on this issue.

Action:

Motion to direct staff to have this issue reviewed by the City attorney and to prepare for the
repeal of Section 8.30.03(c) of City Code.

Reviewed By:
Director of Public Works/Principal City Engineer
City Engineer
City Attorney
Building Official

PW: 09/15/09
