CASE # <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG KENNEL TO MAINTAIN <br />FOUR OR MORE DOGS AT 6738153an LN NW; <br />CASE OF ERIC AND JAMIE TOPERO <br />By: Tim Gladhill, Associate Planner <br />Background: <br />On August 11, 2009, the City received an application from Eric and Jamie Topero for a private kennel <br />conditional use permit to maintain a maximum of four dogs on the property at 6738 153rd Lane NW. City Code <br />allows for a maximum of three dogs per parcel; four or more dogs requires a Conditional Use Permit. <br />Notification: <br />In accordance with State Statute, staff attempted to notify all property owners within 350 feet of the subject <br />property of the request via standard US Mail <br />Observations: <br />The subject properly is approximately 0.90 acres and is zoned R-1 Rural Developing. The Applicant has <br />requested a Conditional Use Permit to allow for five dogs on the Subject Property. These dogs currently reside at <br />the Applicants' current address in Bloomington and consist. of one LabBeagle mix and three Chihuahuas. <br />According to the Applicant, Jamie Topero currently works as a Veterinarian Technician and has stated that it is <br />sometimes necessary to bring a rescued dog home. The Applicants have submitted verification of vaccinations <br />for the four dogs proposed to reside on the Subject Property, included as an exhibit to the findings of fact. <br />The Subject Property is currently owned by Joshua J. and Jennifer M. Kidd, according to Anoka County properly <br />records. The Applicants have stated that they are attempting to purchase the home and relocate to Ramsey from <br />their existing residence in Bloomington. <br />In the previous several applications for a private dog kennel, the City has required some sort of containment <br />system, whether it be permanent fencing, invisible fencing, leash, etc. Staff recommends including this provision <br />in this application as currently drafted in the proposed Conditional Use Permit. <br />Recommendation: <br />The Planning Commission met on September 3, 2009 to hold a Public Hearing regarding the request and <br />recommended that the City Council approve the request as attached. <br />Funding Source: <br />All costs associated with processing the application are the responsibility of the applicant. <br />Commission Action: <br />Motion to adopt Resolution #09-09-_ adopting Findings of Fact # relating to the Applicants' request for a <br />conditional use permit for a private dog kennel for five dogs at 6738 153rd Lane NW. <br />
