Attachment C Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #09-09-_ A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT FOR PRIVATE DOG KENNEL TO MAINTAIN A MAXIMUM OF FOUR DQGS ON A PARCEL OF LAND AT 6730153 LANE NW. WHEREAS, the Ramsey City Council adopted Resolution #09-09-~ adopting Findings of Fact # for this use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY CQUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On September 22, 2009, a Conditional Use Permit ("Permit") was issued by the City of Ramsey ( City) to Eric and Jamie Topero ("Permittee") for a private dog kennel to maintain a maximum of four dogs on the property generally known as 6738 153rd Lane NW and legally described as follows: The west 135 feet of the east 2478.76 feet (as measured along south line) of the south 323 feet of the south half of the northeast quarter of Section 22, Township 32, Range 25, except road subject to easement of record, Anoka County, Minnesota. ("Subject Property"). This Permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this Permit are as follows: 1. This Permit shall remain in effect so long as the conditions imposed herein are. complied with. 2. This Permit shall allow for the maintenance of a maximum of four (4) dogs on the Subject Property over six (6) months of age as well as one (1) temporary care dog as part of Jamie Topero's employment as a Veterinarian Technician. 3. Upon confirmation of any complaints of odor or noise problems relating to the dogs on the Subject Property, the City may take action to abate the nuisance in accordance with Section 5.09.03 (Dog Regulations), subd. 18 (Dogs Disturbing the Peace), of the Ramsey City Code, herein incorporated as reference. 4. That the Subject Property shall be maintained in a sanitary condition according to State and local humane standards.
