Attachment C <br />Councilmember <br />introduced the following resolution and moved for its adoption: <br />RESOLUTION #09-09-_ <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT FOR <br />PRIVATE DOG KENNEL TO MAINTAIN A MAXIMUM OF FOUR DQGS ON A <br />PARCEL OF LAND AT 6730153 LANE NW. <br />WHEREAS, the Ramsey City Council adopted Resolution #09-09-~ adopting <br />Findings of Fact # for this use and herein approves the Conditional Use Permit subject to the <br />following conditions. <br />NOW THEREFORE BE IT RESOLVED BY THE CITY CQUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />On September 22, 2009, a Conditional Use Permit ("Permit") was issued by the City of Ramsey <br />( City) to Eric and Jamie Topero ("Permittee") for a private dog kennel to maintain a maximum <br />of four dogs on the property generally known as 6738 153rd Lane NW and legally described as <br />follows: <br />The west 135 feet of the east 2478.76 feet (as measured along south line) of the <br />south 323 feet of the south half of the northeast quarter of Section 22, Township 32, <br />Range 25, except road subject to easement of record, Anoka County, Minnesota. <br />("Subject Property"). <br />This Permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of <br />this Permit are as follows: <br />1. This Permit shall remain in effect so long as the conditions imposed herein are. complied <br />with. <br />2. This Permit shall allow for the maintenance of a maximum of four (4) dogs on the Subject <br />Property over six (6) months of age as well as one (1) temporary care dog as part of Jamie <br />Topero's employment as a Veterinarian Technician. <br />3. Upon confirmation of any complaints of odor or noise problems relating to the dogs on the <br />Subject Property, the City may take action to abate the nuisance in accordance with <br />Section 5.09.03 (Dog Regulations), subd. 18 (Dogs Disturbing the Peace), of the Ramsey <br />City Code, herein incorporated as reference. <br />4. That the Subject Property shall be maintained in a sanitary condition according to State and <br />local humane standards. <br />
