<br />CASE # ~ <br /> <br />CONSIDER REVISIONS TO CHAPTER 8, SECTION 8.4.4 OF CHARTER <br />REGARDING SPECIAL ASSESSMENT PETITIONS <br />By: William K. Goodrich, City Attorney <br /> <br />Background: <br /> <br />At a July 2009 work session, the City Council held a lengthy discussion on Chapter 8 of <br />the Charter with emphasis on Section 8.4.4 which section is titled 'Petition against <br />Council Initiated Improvement' . <br /> <br />This section provides that when a local improvement is initiated by City Council <br />resolution without a citizen initiating petition, if 50 percent of the property owners <br />proposed to be assessed petition against the local improvement, the improvement may not <br />go forward. We have asked the Mayor and City Engineer to attend the meeting to further <br />explain what they see as the need to amend this section. <br /> <br />Enclosures: <br /> <br />.
