<br />9.17.20 Violations. Any person who shall violate any of the provisions of this <br />Section shall be guilty of a misdemeanor. <br /> <br />9.17.21 Existing WECS. Any WECS in existence as of the effective date of this <br />Ordinance, which do not conform to or comply with this Section of the Code are subject <br />to the following provisions: . <br /> <br />a. The WECS may continue in use for the purpose now used and as <br />now existing but may not be replaced or materially altered without <br />complying in all respects with this Section. <br /> <br />b. ' If such WECS are hereafter damaged or destroyed due to any reason <br />or cause whatsoever, the WECS may be repaired and restored to its <br />former use. location. and physical dimensions upon obtaining a <br />building permit therefor, but without otherwise complying with this <br />Section, provided, however, that if the cost of repairing the WECS to <br />its former use, physical dimensions, and location would exceed 50% <br />of the cost of a new WECS of like kind and quality, then the WECS <br />may not be repaired or restored except in full compliance with this <br />Section. <br /> <br />SECTION 3. SUMMARY <br /> <br />The following is the official summary of Ordinance #09-12 which has been approved by <br />the City Council of the City of Ramsey as clearly informing the public of the intent and <br />effect of the Ordinance. <br /> <br />The Ordinance updates the zoning districts to allow Wind Energy Conversion Systems as <br />a conditional use in the R-1 Residential, R-2 Residential, R-3 Residential, B-1 Business, <br />B-2 Business, E-1 Employment, E-2 Employment Districts and Town Center Sub- <br />Districts 1, 2, 3, &5. Only small-scale WECS shall be permitted in residentially zoned <br />districts. In addition to Small-Scale WECS, Medium-Scale WECS shall also be <br />permitted in B-1, B-2, E-1, and E-2 Districts and Town Center Sub-Districts 1,2, 3, and <br />5. Small-Scale and Medium-Scale WECS is not permitted in the environmental overlay <br />districts. <br /> <br />SECfION 4. EFFECTIVE DATE <br /> <br />The effective date of this Ordinance is thirty (30) days after its passage and publication, <br />subject to City Charter Section 5.07. <br /> <br />Adopted by the Ramsey City Council the 9th day of September 2009. <br />
