9.17.20 Violations. Any person who shall violate any of the provisions of this Section shall be guilty of a misdemeanor. 9.17.21 Existing WECS. Any WECS in existence as of the effective date of this Ordinance, which do not conform to or comply with this Section of the Code are subject to the following provisions: . a. The WECS may continue in use for the purpose now used and as now existing but may not be replaced or materially altered without complying in all respects with this Section. b. ' If such WECS are hereafter damaged or destroyed due to any reason or cause whatsoever, the WECS may be repaired and restored to its former use. location. and physical dimensions upon obtaining a building permit therefor, but without otherwise complying with this Section, provided, however, that if the cost of repairing the WECS to its former use, physical dimensions, and location would exceed 50% of the cost of a new WECS of like kind and quality, then the WECS may not be repaired or restored except in full compliance with this Section. SECTION 3. SUMMARY The following is the official summary of Ordinance #09-12 which has been approved by the City Council of the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. The Ordinance updates the zoning districts to allow Wind Energy Conversion Systems as a conditional use in the R-1 Residential, R-2 Residential, R-3 Residential, B-1 Business, B-2 Business, E-1 Employment, E-2 Employment Districts and Town Center Sub- Districts 1, 2, 3, &5. Only small-scale WECS shall be permitted in residentially zoned districts. In addition to Small-Scale WECS, Medium-Scale WECS shall also be permitted in B-1, B-2, E-1, and E-2 Districts and Town Center Sub-Districts 1,2, 3, and 5. Small-Scale and Medium-Scale WECS is not permitted in the environmental overlay districts. SECfION 4. EFFECTIVE DATE The effective date of this Ordinance is thirty (30) days after its passage and publication, subject to City Charter Section 5.07. Adopted by the Ramsey City Council the 9th day of September 2009.
