<br />Councilmember Wise stated he was not comfortable with this business at this location. <br /> <br />Councilmember McGlone stated he had voted "no" on all three of the previous home <br />occupations as he was against the idea of bringing work home. He believed this fit into the <br />nuisance category and would not support the application. He recommended the business move <br />to an appropriate area withiri the City. <br /> <br />Planning Manager Miller noted she had given Council an amended finding number 11, added a <br />finding, as well as amending numbers 25 and 65 as recommended by the City Attorney. These <br />amendments would be addressed if the Council was considering denial. <br /> <br />Motion by Councilmember Look, seconded by Councilmember Elvig, to adopt Resolution #09- <br />09-205 adopting Findings of Fact #0855 relating to the applicant's request for a home <br />occupation. <br /> <br />Further discussion: City Attorney Goodrich recommended findings 25 and 26 be changed to <br />"will". Councilmember Elvig recommended adding finding number 30 as recommended by <br />Planning Manager Miller: "That during the non-construction season (winter months), when <br />much of the equipment and vehicles associated with Eagle Ridge Services Inc. are not in use, <br />there will be diminished screening due to the leaf-off condition of much of the vegetation; <br />however, the completion of a wood privacy fence would provide some continuity of screening." <br />City Attorney Goodrich recommended amending finding number 11 to read: "That the <br />equipment associated with the applicant's business include a dump truck with contractor's box, <br />dump box trailer, flatbed trailer, trailer for continuous concrete edging, and enclosed trailer and <br />skid steer, all of which will be parked and/or stored on the Subject Property." <br /> <br />Motion carried. V oting Yes: Mayor Ramsey, Councilmembers Look, Elvig, Dehen, Jeffrey, <br />McGlone, and Wise. Voting No: None. <br /> <br />Motion by Councilmember Look, seconded by Councilmember McGlone, to adopt Resolution <br />#09-09-206 denying the issuance of a home occupation permit to Mark Lofgren at 16705 <br />Germanium Street NW (permittee) to operate a general contractor business on a residential <br />property and declare terms of same. <br /> <br />Further discussion: Councilmember Jeffrey asked if there would be a transition time period to <br />move the business. Planning Manager Miller responded typically when there was an ordinance <br />complaint, they had a 14-day notice, but she was not sure if this was sufficient time. She asked <br />for Council's guidance. Councilmember Elvig agreed they needed sufficient time to vacate the <br />business and recommended 90 days from today's date. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember McGlone, to amend the motion <br />to move the business in 90 days. <br /> <br />Further discussion: Councilmember Dehen asked if they had to cease business within 90 days or <br />move the business within 90 days.
