Upon a showing of indigency or undue hardship upon the convicted person or the convicted person's immediate family, the sentencing court may authorize payment of the surcharge in installments. (d) The court administrator or other entity collecting a surcharge shall forward it to the commissioner of finance. (e) If the convicted person is sentenced to imprisonment and has not paid the surcharge before the term of imprisonment begins, the chief executive officer of the correctional facility in which the convicted person is incarcerated shall collect the surcharge from any earnings the inmate accrues from work performed in the facility or while on conditional release. The chief executive officer shall forward the amount collected to the commissioner of finance. (f) The surcharge does not apply to administrative citations issued pursuant to section 169.999. . Sec. 8. COMMISSIONER OF PUBLIC SAFETY; CREATE UNIFORM ADMINISTRATIVE CITATION. No later than October 1. 2009. the commissioner of public safety shall create a uniform administrative citation to be issued under Minnesota Statutes. section 169.999. The commissioner shall consult with representatives from the Sheriffs Association of Minnesota. the Minnesota Chiefs of Police Association. and the Minnesota Police and Peace Officers Association on the form and content of the uniform administrative citation. Sec. 9. SEVERABILITY. If any provision of this act. or the apolicability of any provision to any person or circumstance. is held to be invalid by a court of competent iurisdiction. the remainder of this act is not affected and must be given effect to the fullest extent practicable. Sec. 10. EFFECTIVE DATE. Sections 2 and 3 are effective August L 2009. and the amendments made in sections 2 and 3 to Minnesota Statutes. sections 169.011 and 169.045. exoire July 3 L 2012.
