Background:
At the present time section 8.30.03 (c) of the City code which addresses sewage disposal systems
in the City allows property owners to install a septic system on their own property without a state
license provided that they sign an indemnification agreement. A copy of this section of the City
code is attached. This City ordinance conflicts with section 2.12 of the Anoka County Sewage
Treatment Ordinance which is also attached. The County ordinance states that all work on
sewage disposal systems must be performed by licensed persons. Finally and also attached is
State Statute 145A.05subd. 9. This section of state law requires that cities must not be in conflict
within, or less restrictive than, ordinances of the county relating to public health.
Recommendation:
Staff recommends that the City repeal section 8.30.03 (c) of the City code to come into
compliance with County and State codes.
Action:
Motion to direct the City Attorney to prepare an ordinance to repeal section 8.30.03 (c) of the
City Code to come into compliance with County ordinance and State law.
Reviewed By:
City Administrator
Director of Public Works /Principal City Engineer
City Engineer
City Attorney
Building Official
CC: 10/13/09
CONSIDER AMENDING CITY CODE REGARDING
SEPTIC SYSTEM INSTALLATION
By: Steven Jankowski, Assistant City Engineer
CASE #
