('eer\ \Zc~JJ ' 111111111111111111111111111111111111111111111 Record 10 2245231 J' Board Member Levine introduced the following resolution and moved for its adoption: RESOLUTION #09-08-165 2010268.002 RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE, VARIANCE TO FRONT YARD SETBACK, AND SIDEWALL HEIGHT RESTRICTIONS WHEREAS, Russell Peterson, hereinafter referred to as "Applicant," has properly applied for a variance from Section 9.11.02 (Accessory Structures) of the Ramsey City' Code to construct an accessory structure nearer the front property line than the principal structure on the property generally known as 17725 Nowthen Blvd NW and legally described as follows: That part of the Southeast Quarter of the Northwest Quarter of Section 3, Township 32, Range 25, Anoka County, Minnesota described as follows: Commencing at the intersection of south line of said Quarter Quarter and center line of CSAH No.5, said point of intersection being 862.82 feet west of southeast comer of said Quarter Quarter, thence northwesterly along said center line along a curve concave to northeast having a radius of 1800.40 feet a center angle of 8 degrees 47 minutes 276 feet to point of beginning, chord to said curve bears north 40 degrees 02 minutes 05 seconds west, thence continuing northwesterly along said centerline along same described curve to right having a radius of 1800.40 feet with a central angle of 1 degree 03 minutes 32.99 feet, thence north 35 degrees 07 minutes 05 seconds west 150 feet, thence northeasterly at a right angle and to a point which is'749.56 feet west of east line of said Quarter Quarter; as measured along said line thereof, thence southerly parallel with east line of said Quarter Quarter to a point which is 373.37 feet north of south line of said Quarter Quarter, as measured along east line thereof, thence west parallel with south line of said Quarter Quarter to intersect with a line drawn from point of beginning on a bearing of north 53 degrees 49 minutes 55 seconds east, thence south 53 degrees 49 minutes 55 seconds west to point of beginning, except road subject to easement of record. (Subject Property). AND WHEREAS, the Board of Adjustment conducted a public hearing on August 6, 2009, pursuant to Section 9.03.07 of the Ramsey City Code. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF :THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That based on Findings of Fact #0849, a variance to construct an accessory building nearer the front property line than the principal building, with a setback of 93 feet to centerline, and sidewall height to match the existing accessory structure (the "Variance") on the Subject Property is hereby granted.
