City Attorney Goodrich requested that the motion be subject to the unanimous approval of the
subsequent resolution presented with this case.

Councilmember Look accepted the friendly amendment to the motion.

Councilmember Wise accepted the friendly amendment to the motion.

A roll call vote was taken:

Councilmember Look - aye
Councilmember Wise - aye
Councilmember Dehen - aye
Councilmember Elvig - aye
Councilmember Jeffrey - absent
Councilmember McGlone - abstain
Mayor Ramsey - aye

Motion carried.

City Attorney Goodrich stated the City Council also needs to authorize City staff, on behalf of
the City, to enter into a contract with an interested Councilmember by adopting a resolution,
which is a resolution to contract with a Councilmember under Minn. Statute Section 471.88
subdivision Sand 471.89 subdivision 2.

Motion by Councilmember Look, seconded by Councilmember Wise, to adopt Resolution #09-
08-194 to contract with a Councilmember which resolution is contingent on the City Attorney
confirming that the term "unanimous" as used in the relevant statute may be interpreted as the
unanimous vote of those City COuilcilmembers present when the matter is voted on.

Further Discussion: Councilmember Elvig stated it appears that Contractors & Consultants is the
only contractor that can provide the color selected by the City. He stated if the City wishes to
standardize all materials used in the parks, the Council is essentially standardizing to this
particular contractor.. Councilmember Dehen stated that even though this is a relatively small
job, he felt it was appropriate for staff to obtain more than three quotes. Deputy City
Administrator Nelson stated that four quotes were solicited but she only received three quotes.

A roll call vote was taken:

Councilmember Look - aye
Councilmember Wise - aye
Councilmember Dehen - aye
Councilmember Elvig - aye
Councilmember Jeffrey - absent
Councilmember McGlone - absent from the Chambers
Mayor Ramsey - aye

City Council!
