Only the fact that the <br />city was put on notice BEFORE 1561h Avenue NW was reconstructed theplan was <br />legally deficient in the handling the runoff created by the paving of the West end of 1561h <br />Avenue. . - .. <br /> <br />The City ultimately ignored the warning and reconstructed 1561h A ven:ue NW increasing <br />runoff, conveying the runoff and ultimately discharging it onto my property. Improperly <br />discharging water onto my property constitutes inverse condemnation. <br /> <br />As a result of the city's undisputed obligation to properly care for the runoff created by <br />the reconstruction of 1561h Avenue NW the city promised to con-ect the situation and a <br />public improvement project was written, and approved that would facilitate the proper <br />discharge of the runoff into wetland 656W. Through various iterations this project is <br />purportedly included in improvement project 04-STRM-013. <br /> <br />The original project when first written was to include obtaining drainage easements from <br />several landowners, installing a culveli and the removal of natural and manmade <br />impediments preventing nmofffi'0l11 a low area on the West end of 156th Avenue NW <br />actually reaching wetland 656W. <br /> <br />The improvement project as originally drafted did nothing more than meet the cities legal <br />obligation to properly accommodate the increased drainage it created with the <br />reconstructing 1561h Avenue NW. I have now patiently waited for many years for this <br />promised public improvement project that should have been completed concun-ent with <br />the reconstruction of 156111 A venue NW NOT TEN or TWENTY years later. <br />
