Councilmember introduc~.d the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-08- <br /> <br />A RESOLUTION APPRO~E[NG THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO MICH_kEL ST. HILAIRE TO EXCEED TITE SIZE RESTRICTIONS leOR A <br />DETACHED ACCESSORY BUILDING ON PROPERTY FROM 1-1.9 ACRES <br />DECLARING TERMS OF <br /> <br /> WHEREAS, Michael St. Hilaire (Permirtee) has properly applied for a conditional use <br />permit to exceed detached accessory building size restrictions for prope~ies bom 1-1.9 acres <br />established m sec:ion 9.11.02 "Accessory. Uses" of City Code on the property generally known as <br />4740 !57 Lane and legally descr/bed as follows: <br /> <br />Lot 3, Block t, Petersons Estates, Amoka County, Minnesota <br /> <br />(Subject Property) <br /> <br /> WTffEREAS, the Plamm_ing Commission met on August 7. ~00.~, conducted the <br />public heating and recommended City.' Council approval o£ the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOI, L':k COU~'TY, STATE OF MIN~'ESOTA, as follows: <br /> <br />Based on Findings of Fact #__, a Conditional Use Permit (Permit) to exceed detached <br />accessory, building height restrictions for properties from 1-1.9 acres as established in City <br />Code, is hereby #anted to Mict~ael St. Hilaire, hereinafter ~refe~ed to as the "Permirtee". <br /> <br />That the detached accessory..' building may exceed the 1,664-square-foot detact~bd accessory <br />building size restriction for prope~ies from 1-1.9 acres by a total of 552 square feet in order <br />to store vehicles and other personal property.. <br /> <br />3. That the detached accessory, building constructed on the property will comply with the <br /> pe~wnitted accessory, structure height restr4ctions established in City' Code. <br /> <br />That the construction of the detached accessory building on the Subject Prope~, shall require <br />issuance of a building permit ~'rom the City- of Ramsev and the Pem~ittee is allowed ro use <br />vinyl or hardboard siding as exterior material for the building. <br /> <br />5. That the accessory..' building shall be properly constructed and maintained in accordance with <br /> all applicable Uniform Building Codes. <br /> <br />6. The Permittee herein agrees that no business or residential use will be operated in the <br /> detached accessou building unless such use is permitted in accordance with the City.
