RIVENWICK 3lm ADDITION <br /> SUPPLEMENTAL AGREEMENT <br />CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, <br />a municipal corporation under the laws of the State of Minnesota (the "CITY"), and TURTLE <br />MOON INC., a Minnesota corporation, whose address is 3812 Coon Rapids Blvd., Coon Rapids <br />MN, 55433 ("DEVELOPER"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER is the fee owner of the following described property <br />situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described <br />as follows: <br /> <br />Lots 1, 2, 3, 4, 5, 6, Block 1, and Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, Block 2, Rivenwick <br />3rd Addition, Anoka County, Minnesota. <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, on March 11, 2003, pursuant to Resolution No. 03-03-__, the CITY <br />approved the final plat of the Subject Property which plat is known as RIVENWlcK 3RI> <br />ADDITION (the "Plat"); and <br /> <br /> WHEREAS, the City and-the developer have entered into a Development A~eement <br />dated ; and <br /> <br /> WHEREAS, Section 1 Paragraph 41 of the Development Agreement idehtifies traffic <br />signals at Ramsey Boulevard and Highway 10 as a Stage I Improvement for which-the Developer <br />is responsible for installing; and <br /> <br /> WHEREAS, certain conditions involving Mn/DOT scheduling and development <br />associated with the Ramsey Town Center require a delay in implementing the permanent traffic <br />signals at said intersection; and <br /> <br /> WHEREAS, Mn/DOT will require agreements between itself and the City for the <br />installation of temporary and permanent traffic signals at this intersection <br /> <br />NOW THEREFORE, THE CITY AND DEVELOPER AGREE, as follows: <br /> <br />Item <br /> <br />The Developer shall be responsible for the design and installation of temporary <br />signals at the intersection of TH10 and Ramsey Boulevard. The design shall be <br />approved by Mn/DOT. The Developer shall also be responsible for any costs <br />associated with the inspection of these signals. <br /> <br />-257- <br /> <br /> <br />
