RIVENWICK 3lm ADDITION SUPPLEMENTAL AGREEMENT CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a municipal corporation under the laws of the State of Minnesota (the "CITY"), and TURTLE MOON INC., a Minnesota corporation, whose address is 3812 Coon Rapids Blvd., Coon Rapids MN, 55433 ("DEVELOPER"). WITNESSETH: WHEREAS, the DEVELOPER is the fee owner of the following described property situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described as follows: Lots 1, 2, 3, 4, 5, 6, Block 1, and Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, Block 2, Rivenwick 3rd Addition, Anoka County, Minnesota. (the "Subject Property"); and WHEREAS, on March 11, 2003, pursuant to Resolution No. 03-03-__, the CITY approved the final plat of the Subject Property which plat is known as RIVENWlcK 3RI> ADDITION (the "Plat"); and WHEREAS, the City and-the developer have entered into a Development A~eement dated ; and WHEREAS, Section 1 Paragraph 41 of the Development Agreement idehtifies traffic signals at Ramsey Boulevard and Highway 10 as a Stage I Improvement for which-the Developer is responsible for installing; and WHEREAS, certain conditions involving Mn/DOT scheduling and development associated with the Ramsey Town Center require a delay in implementing the permanent traffic signals at said intersection; and WHEREAS, Mn/DOT will require agreements between itself and the City for the installation of temporary and permanent traffic signals at this intersection NOW THEREFORE, THE CITY AND DEVELOPER AGREE, as follows: Item The Developer shall be responsible for the design and installation of temporary signals at the intersection of TH10 and Ramsey Boulevard. The design shall be approved by Mn/DOT. The Developer shall also be responsible for any costs associated with the inspection of these signals. -257-
