Absent: Chairperson Van Scoy. <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Public Hearing - Request for a Variance to Construct an Open Deck that <br />Encroaches on the Setback from the Ordinary High Water Mark of the <br />Mississippi River at 14750 Bowers Drive NW; Case of Terry and Diane <br />Geladaker <br /> <br />Chairperson Cleveland closed the regular portion of the Board of Adjustment meeting at 7:07 <br />p.m. inorder to conduct the public hearing. <br /> <br />Public Hearin2 <br /> <br />Chairperson Cleveland called the public hearing to order at 7:07 p,m. <br /> <br />Presentation <br /> <br />Environmental Coordinator Anderson explained that the request was to construct a deck that <br />would encroach on the setback for the Mississippi River. He provided some background <br />information on the home, neighborhood, and setback regulations. He advised that the <br />homeowners would like to construct a 10 by 14 foot deck on the backside of the home. He stated <br />that the property located to the north is 80 feet from the high water mark of the river, while the <br />home to the south of the property is 155 feet from the high water mark. He stated staff <br />recommends approval of the variance, as the request would not be more of an encroachment than <br />an average of the setback of the adjacent developed properties. He advised that the DNR also did <br />not see any issues with the variance request. <br /> <br />Citizen Input <br /> <br />Terry Geladaker, 14750 Bowers Drive, explained that when the home was built there was a <br />variance included for 10 feet of encroacJ:unent for the purpose of a deck. He explained that the <br />extra four feet of the deck would match the bay of the home. <br /> <br />Motion by Board Member Levine, seconded by Board Member Rogers, to close the public <br />hearing. <br /> <br />Motion Carried. V oting Yes: Acting Chairperson Cleveland, Board Members Levine, Rogers, <br />Brauer, Dunaway, and Hunt. Voting No: None.
