Planning and Zoning Com'n of <br />Town of Plymouth, 292 Conn. 317,973 A.2d 64 (2009) . <br /> <br />CONNECTICUT (06/30/09)-Buttemiilk Farms, LLC sought to subdi- <br />vide its thirty-eight acre property in the town. It filed a subdivision applica- . <br />tion with the town's planning and zoning commission (the "PZC"). Butter- <br />milk proposed subdivi~g the property into five buildable residential lots. <br />The entire frontage of the proposed subdivision abutted a ten foot strip of <br />unpaved land on the southeast side of a town road (the "Road"). This ten <br />foot strip was p~ of the fifty foot Road right-of-way. Buttermilk did not <br />propose construction of any new roaqs exclusively within the subdivision; <br />nor did it propose any new roads that would intersect with the Road. <br />The PZC told Buttermilk that before its application could be ap- <br />proved, Buttermilk had to include a sidewalk along the UIipavedshoul- <br />der of the Road adjacent to its property.
