<br />Attachment C <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #09-12- <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #_ RELATING TO A REQUEST <br />FROM MARK HILLIARD FOR A VARIANCE TO CONSTRUCT A DETACHED <br />ACCESSORY STRUCTURE NEARER THE FRONT PROPERTY LINE THAN THE <br />PRINCIPAL STRUCTURE AT 5161156TH LANE NW <br /> <br />WHEREAS, Mark Hilliard, hereinafter referred to . a~ the "Applicant," has properly <br />applied for a variance from Section 9.11.02 (Accessory Uses and Buildings) of the Ramsey City <br />Code to construct an accessory building nearer the front property line than the principal structure <br />(the "Structure") on the property generally known as 5161 156th Lane NW and legally described <br />as follows: <br /> <br />Lot 4, Block 3, Reilley Estates 3rd Addition, Anoka County, Minnesota, subject to <br />easement as shown on plat. <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Board of Adjustment for a puplic hearing pursuant <br />to Section 9.03.07 of the Ramsey City Code on December 3, 2009, and that said public <br />hearing was properly advertised, and that the minutes of said public hearing are hereby <br />inco1jJorated as a part of these findings by reference. <br /> <br />2. That the Subject Property is zoned R-1 Rural Developing. <br /> <br />3. That that Subject Property is approximately 0.84 acres (36,595 square feet) in size. <br /> <br />4. That the Subject Property is surrounded by properties also zoned R-1 Rural Developing <br /> <br />5. That according to the certificate of survey produced by E. G. Rud & Sons, Inc., dated July <br />20, 1993, the dwelling unit appears to meet applicable setbacks. <br /> <br />6. That the Applicant is proposing to construct a fourteen by twenty-two foot (14' x 22') <br />accessory building (the "Structure") on the Subject Property. <br /> <br />7. That MN Rules Chapter 7080 requires a minimum setback of twenty (20) feet between an <br />individual sewage treatment system (ISTS) and a building. The Structure appears to be <br />approximately twenty-two (22) feet from the private septic system. <br /> <br />10 <br />
