<br />4.5.5.3 Vacancy in an office not to be voted on in the Regular Municipal <br />Election. If a vacancy occurs in the office of the mayor or a councilmember not standing <br />for election in the Regular Municipal Election, a special primary election and a special <br />election shall be held in January of the subsequent year following the vacancy to fill said <br />vacancy. The election procedures for the special primary election and the special election <br />shall be those election procedures for municipal office, candidates as prescribed in <br />Minnesota Statutes and this Charter. Notwithstanding Section 2.3.1 of this Charter, <br />which provides for a four-year term for the mayor and councilmembers, the term of the <br />mayor and/or a councilmember elected pursuant to this subsection will be for the <br />remainder of the vacant term. <br /> <br />SECTION 3. EFFECTIVE DATE. <br /> <br />This Ordinance shall become effective 90 days after its passage and publication subject <br />to the provisions of Minnesota Statutes S410.12, Subd. 7. <br /> <br />The motion for the adoption of the foregoing Ordinance was made by Councilmember Elvig and <br />was duly seconded by Councilmember Wise and upon vote being taken thereon, the following <br />voted in favor thereof: <br /> <br />Mayor Ramsey <br />Councilmember Elvig <br />Councilmember Wise <br />Councilmember Dehen <br />Councilmember Jeffrey <br />Councilmember Look <br />Councilmember McGlone <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br />Whereupon said Ordinance was declared duly passed and adopted/not adopted by the Ramsey <br />City Council the 8th day of December 2009. <br /> <br />~d <br /> <br />Mayor Bob Rams-;-7 <br /> <br />Ordinance #09-18 <br />Page 2 of3 <br />
