Irvin, 2009 WL 3209206 (Ga. Ct. App. 2009) <br /> <br />GEORGIA (10/08/09)-Ingram-Pike County Properties, Inc. <br />owned land in the county (the "Land"). GRAALGroup, LLC and <br />Ingram sought to rezone the Land from agricultural to commercial. <br />. They applied to the county's Board of Commissioners (the "Board") <br />for the rezoning. <br />The .Board granted GRAAL and Ingram the requested rezoning. <br />Thereafter, an action was filed in Superior Court, seeking a decla- <br />ration that the rezoning was invalid. During a hearing on Octo- <br />ber 23, 2008, the Superior Court found that the county failed to <br />comply with notice provisions of county ordinances and state law. <br />Based on that failure, the court set aside the Board's decision to <br />grant the rezoning. <br /> <br /> <br />WEST@ <br /> <br />610 Opperman Drive.
