It "offers mor'e protection of development rights <br />than the rule generally applied in other jurisdictions." Under <br />the rule followed in the majority of jurisdictions, development <br />rights do not vest (and become immune from subsequently ad- <br />opted regulations) until both: (1) a building permit has been <br />obtaihed;and (2) substantial development has occurred in reli- <br />ance on the permit. <br /> <br />Case Note: Here, the city did not have a vesting ordinance. Mu- <br />nicipalities can adopt a local vesting ordinance that specifies an <br />earlier vesting date (than the filing of a building permit applica- <br />tion).
