<br />city council members and they said $600 would be a minimum investment, so he knew he was <br />going to look at $1,500 - $2,000 just for the variance process. He stated that he would bet that <br />half of the people in less populated areas are building without permission and he just happened to <br />be reported. He continued he thinks it is the best location for the structure and he took the risk of <br />penalty because he thought the variance process would justify itself. He stated again that if he <br />built in the alternate location, he would not be able to get to his well for replacement. <br /> <br />Board Member Brauer questioned if the City told him he needed a variance before he even put a <br />single nail in. <br /> <br />Mr. Hilliard stated yes and continued that the key point here is that the alternate location puts <br />undue hardship on him if his well needs replacement. <br /> <br />Board Member Brauer questioned ifMr. Hilliard made the decision to build anyway. <br /> <br />Discussion ensued as to the reason Mr. Hilliard proceeded with the structure without the <br />necessary permits. <br /> <br />Mr. Hilliard reiterated a well truck cannot access his well if the structure is moved to the <br />recommended location. <br /> <br />Board Members stated they are citizens of Ramsey also and want to help Mr. Hilliard with his <br />variance. Information validating the alternate location is not feasible needs to be brought to the <br />Board. Mr. Hilliard questioned what type of information the board required. <br /> <br />Mr. Hilliard would like to work with Associate Planner Gladhill to have a site evaluation with <br />this new information he has brought forward to the Board. <br /> <br />Associate Planner Gladhill stated that he could bring to the board some facts on well truck sizes, <br />etc., from Mr. Hilliard's contractor, however, Staff cannot take the liability to state that a truck <br />will or will not fit in the back yard. <br /> <br />Chairperson VanScoy clarified that the removing of trees to put up a structure is not a hardship. <br />Staff is trying to accommodate the applicant by providing an opportunity for the structure to be <br />located in a place with minimal impact to existing trees. He understands the desire not to remove <br />trees; however that is not a hardship. <br /> <br />Associate Planner Gladhill stated literal interpretation of code, excluding the trees, there would <br />be sufficient space in the backyard. There are some topography and contours that could be <br />addressed but, excluding, setbacks, bulk standards, and allotment of square footage, there would <br />be enough space. <br /> <br />Discussion ensued regarding tree preservation in regards to the location of the structure. <br /> <br />Board Member Brauer advised the applicant to return with information such as; where the well is <br />on the property, location of utilities, septic drain, electrical and then a layout of drive way where <br /> <br />Board of Adjustment/December 3, 2009 <br />Page 3 of 4 <br />
