<br />Chairperson VanScoy introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #09-11-254 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0857 RELATING TO A REQUEST <br />FROM ROGER AND BARBARA ANDERSON FOR A VARIANCE TO CONSTRUCT A <br />DETACHED ACCESSORY STRUCTURE NEARER THE FRONT PROPERTY LINE <br />THAN THE PRINCIPAL STRUCTURE AT 5421165TH LANE NW <br /> <br />WHEREAS, Roger and Barbara Anderson, hereinafter referred to as "Applicants," have <br />properly applied for a variance from Section 9.11.02 (Accessory Uses and Buildings) of the <br />Ramsey City Code to construct an accessory building nearer the front property line than the <br />principal structure on the property generally known as 5421 165th Lane NW and legally described <br />as follows: <br /> <br />Lot 6, Block 1, White Pine Estates, subject to easement as shown on plat, <br />Anoka County, Minnesota <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicants appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.07 of the Ramsey City Code on November 5, 2009, and that said public <br />hearing was properly advertised, and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />2. That the Subject Property is zoned R-1 Rural Developing. <br /> <br />3. That that Subject Property is approximately 1.30 acres in size. <br /> <br />4. That the Subject Property is surrounded by properties also zoned R-1 Rural Developing. <br /> <br />5. That the Subject Property is a riparian lot within the Wild and Scenic River Overlay <br />District. <br /> <br />6. That in 1981, the City of Ramsey adopted Section 9.23.06 (Scenic River District <br />Provisions) of City Code, which requires buildings to be setback at least 150 feet from the <br />Ordinary High Water Mark (OHWM) of the river. <br /> <br />7. That according to the certificate of survey produced by John Oliver and Associates, dated <br />December 22, 1977, the principal structure is located approximately 140 feet from the <br />OHWM. <br />
