<br />Councilmember Look introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #09-11-262 <br /> <br />A RESOLUTION ORDERING THE ASSESSMENT OF SEPTIC SYSTEM REPAIR AT <br />16207 AZURITE STREET <br /> <br />WHEREAS, the onsite septic system serving the property located at 16207 Azurite Street has <br />failed and is a public health hazard; and, <br /> <br />WHEREAS, the Owner has been ordered to be repair or replace the failed system; and, <br /> <br />WHEREAS, the City has adopted a policy entitled "Septic System Repair" to address for the <br />repair of failed systems through special assessment of the costs to the property; and, <br /> <br />WHEREAS, the Owner is unable to finance the repair! replacement of the property's onsite <br />septic system and has requested the repair of the system under the terms of the Policy. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, that. the repair of the septic <br />system located at 16702 Azurite Street be caused to be repaired in accordance with the City's <br />Septic Repair Policy subject to the following contingencies: <br /> <br />1. The costs of said repair be assessed along with an administrative fee of 25% of the total <br />repair along with the normal interest charged by the City in assessment matters. <br />2. The property owners provide evidence of denial of funding for said repair by Anoka <br />County Community Action Program (ACCAP) and the Greater Metropolitan County <br />Housing Resource Center. <br />3. The property owners enter into an Agreement of Assessment and Waiver of Irregularity <br />and Appeal which accepts the assessment of the repair costs to the property and waives <br />the right to challenge or dispute the amount. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Wise, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Ramsey <br />Councilmember Look <br />Councilmember Wise <br />Councilmember Dehen <br />Councilmember McGlone <br /> <br />and the following voted against the same: <br /> <br />none <br /> <br />and the following abstained: <br /> <br />RESOLUTION #09-11-262 <br />Page 1 of2 <br />
