Subd. 3. Penalties. Failure to meet the requirements of the <br />Compliance Order shall be a violation of this Section and a misdemeanor and is subject <br />to all penalties as provided by State Statute. Each day the violation continues in <br />existence shall be deemed a separate violation. <br /> <br /> Subd. 4. Execution of Compliance Orders. Upon failure to <br />comply with a Compliance Order within the time set and no appeal having been taken, <br />the Council may, by resolution, cause the cited deficiency to be remedied as set forth in <br />the Compliance Order. The cost of such remedy shall be levied against the subject <br />property and may be levied and collected as a special assessment in the manner provided <br />by Ci!y Charter. <br /> <br /> Subd. 5. Appeal. When it is alleged by any person to whom a <br />Compliance Order is directed that such Compliance Order is based upon erroneous <br />interpretation of this section, such person may appeal the Compliance Order as set forth <br />in {}9.03.07 entitled "Board of Adjustment". Such appeal must be in writing, specify the <br />grounds for the appeal, and be filed with the Zoning Administrator within ten (10) <br />business days after service of the Compliance Order. The decision of the Board of <br />Adjustment may be appealed to the City Council. The filing of an appeal shall stay all <br />proceedings, unless such a stay would cause imminent peril to life, health, safety or <br />property. <br /> <br /> Subd. 6. Emergency Cases. When a violation of this Section <br />constitutes an imminent peril to life, health, safety or property, the City may require <br />immediate compliance and if necessary take appropriate action to correct the violation. <br /> <br /> Subd. 7. Restrictions on Transfer of Ownership..The owner of <br />any building, or any part thereof, upon whom a pending Compliance Order has been <br />served, may not sell, transfer, mortgage, lease, or otherwise dispose of the building or any <br />part thereof, to another person until the provisions of the Compliance Order have been <br />complied with, unless such owner shall furnish to the grantee, lessee, or mortgagee a true <br />copy of any notice of violation or Compliance Order and shall obtain and possess a <br />receipt of acknowledgement. Anyone securing an interest in the building, or any part <br />thereof, who has received notice of the existence of a violation or Compliance Order shall <br />be bound by such violation or Order without vurther service of notice and shall be liable <br />for all penalties and procedures provided by this Chapter. <br /> <br />8.60.11 <br /> <br />Notice of Agents, Operators, Managers, and Officers.. <br /> <br /> Subd. 1. Common Interest Facilities. The association of any <br />common interest facility shall notify the City in writing of the name, address, and <br />telephone number of the association president, or other authorized contact individual, and <br />shall renotify the City in writing of any change in the identity, address, or telephone <br />number of that individual. <br /> <br /> <br />
