b. The length of time that the adult use has been operating. <br /> <br />c. The ease by which the property could be converted to a conforming use. <br /> <br />d. The nature and character of the surrounding neighborhood. <br /> <br />e. The value and condition of the improvements on the property. <br /> <br />f. The amount of the applicant's investment in the business. <br /> <br />g. The amount of investment already realized. <br /> <br />h. The cost of relocating the adult use. <br /> <br />9.11.14 Compliance. In order to assure compliance with the performance standards set <br />forth above, the Council may require the owner or operator of any permitted use to make such <br />investigations and tests as may be required to show adherence to above performance standards. <br />Such investigation and tests as are required to be made shall be carried out by an independent <br />testing organization as may be agreed upon by the City and the owner or operator, or if there is <br />failure to agree within ten days after written notice by the City to the owner or operator to make <br />such investigation and tests, by such independent testing organization as may be selected by the <br />Council. The costs incurred in having such investigations or tests conducted shall be borne <br />entirely by the owner or operator. The procedure stated above shall not preclude the City from <br />taking any such other tests and investigations it finds appropriate to determine compliance with <br />these performance standards. <br /> <br />SECTION 3. SUMMARY <br /> <br />The following official summary of Ordinance #03-30 has been approved by the City Council of <br />the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. <br /> <br />It is the intent and effect of Ordinance #03-30 to amend Ramsey City Code Chapter 9 (Zoning <br />and Subdivision of Land), Subsection 9.11 (Performance Standards) to update Subsections <br />9.11.02 General Provisions, 9.11.02 Accessory Uses, 9.11.04 Home Occupations, 9.11.07 <br />Nuisances, 9.11.10 Off-Street Parking, 9.11.13 Off-Street Parking, and 9.11.14 Off-Street <br />Loading; and to eliminate Subsections 9.11.03 Conforming Use Designation and Existing Uses <br />in the "4 in 40" Density District, 9.11.08 Driveways, 9.11.09 Screening, 9.11.11 Traffic Control, <br />9.11.12 Soil Erosion, 9.11.16 Height Regulations, 9.11.17 Fences, 9.11.20 Non-Residential <br />Development Standards. No amendments were made to Subsections 9.11.05 Manufactured <br />Housing, 9.11.06 Incineration Burning, 9.11.15 Permitted Encroachments, 9.11.18 Grading, <br />Mining and Filling Permits, and 9.11.19 Adult Uses. <br /> <br />SECTION 4. EFFECTIVE DATE <br /> <br />The effective date of this ordinance is thirty (30) days after its passage and publication, subject to <br />City Charter Section 5.07. <br /> <br />Adopted by the Ramsey City Council the 12th day of August 2003. <br /> <br />Mayor <br /> <br />27 <br /> <br /> <br />
