<br />Attachment H <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />Board Member, <br /> <br />RESOLUTION #10-02-_ <br /> <br />RESOLUTION APPROVING THE ISSUANCE- OF A VARIANCE TO CONSTRUCT AN <br />ACCESSORY BUILDING 'NEARER THE FRONT PROPERTY LlNE THAN THE <br />PRINCIPAL STRUCTURE AT 5161156TH LANE NW AND DECLARING TERMS OF <br />SAME <br /> <br />WHEREAS, Mark D. and Mary A. Hilliard (the, '~Pennittee") have'properly applied for a <br />variance from Section 117-349 (Accessory Uses and Buildings) of the Ramsey City Code to <br />construct an accessory building nearer the front property line than the principal structure on the <br />property generally known as 5161 156th Lane NW and legally described as follows: <br /> <br />Lot 4, Block 3, Reilley Estates 3rd Addition, Anoka Co~ty,Minnesota, subject to <br />. easement' as shown on plat. <br /> <br />(the "Subject Property"). <br /> <br />AND WHEREAS, the Boar4 of Adjustment conducted a public hearing on December 3, <br />2009, pursuant to Section 9.03.07 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOL YED BY THE BOARD OF ADJUSTMENT OF THE <br />J" CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />\, <br /> <br />1. That based on'Findings of Fact #_, a variance to construct a detached accessory building <br />nearer the front property line than the principal structure on the Subject Property is hereby <br />granted. ' , <br /> <br />2. That the accessory building constru~ted on the Subject Property shall not be located any <br />closer than eighty (80) feet from the front property line, fifty (50)feet from the east p~operty <br />line, and one hundred (100) feet from the west property line. <br /> <br />3. That the exterior fInish of the proposed building shall match that of the principal structure, <br />including soffit, fascia, and eave overhang. <br /> <br />4. That the Permittee shall be responsible for all costs incurred in 'administering an~ enforcing <br />this variance. ' <br /> <br />5. Thatthe Permittee shall obtain all necessary permits prior to commencing any construction of <br />the accessory building, including, qut not limited to, a Building Permit. <br /> <br />56 <br />
