Board of County C01n'rsJ 2009 WL <br />3491015 (Kan. 2009) <br /> <br />KANSAS {10/30/09)-The Board, of County Commissioners <br />(the "Board") amended the county zoning regulations to prohibit <br />commercial wind farms in the entire county of approximately 800 <br />square miles {the "Amendment"). . <br />Certain, owners of land in the county (the "Landowners") had <br />entered into written contracts for the development of commercial <br />wind farms on their properties. Other individuals owned "'wind <br />. rights"on properties in the countY (the "Wind Right Owm:rs"). <br />After the Amendment was adopted by the Board; the Landown- <br />ers sued the Board in district ~ourt.
