ORDINANCE #03-35 <br /> <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AN ORDINANCE AMENDING CHAPTER 3.20 OF THE <br />"PERSONNEL POLICY" BY THE ADDITION OF 3.20.24 <br />HISTORY BACKGROUND INVESTIGATIONS." <br /> <br />CITY CODE, TITLED <br />TITLED "CRIMINAL <br /> <br />SECTION 1. AMENDMENT <br /> <br />The following text is hereby incorporated into Chapter 3.20, Personnel Policy, of the City Code. <br /> <br />Section 3.20 Personnel Policy <br /> <br />Section 3.20.24 Criminal History Background Investigations <br /> <br />Subdivision 1. Authority <br /> <br />Minnesota Statute, Section 13.87 authorizes city police departments to conduct criminal history <br />background investigations on applicants for City positions using Minnesota Computerized <br />Criminal History data. <br /> <br />Subdivision 2. Applications <br /> <br />This section applies only to applicants who are finalists for regular, temporary and volunteer <br />status positions. Before the investigation is undertaken, the applicant must authorize the Police <br />Department in writing to undertake the investigation and to release the information to the City <br />Council, City administrator and/or other City staff as appropriate. <br /> <br />Subdivision 3. Rejection of Applications <br /> <br />Except in the case of exceptions set forth in Minnesota Statutes Section 364.09, as may be <br />amended from time to time, if the City rejects an application for employment due partly or solely <br />to the applicant's prior conviction of a crime which relates directly to the position sought, the <br />City's Human Resources Manager will notify the applicant in writing of the following: <br /> <br />A. the Grounds and reasons for denial; <br />B. the applicant complaint and grievance procedure set forth in Minnesota Statute <br /> Section 364.06, as may be amended from time to time; <br />C. the earliest date the applicant may reapply for employment or a volunteer position; <br /> and <br />D. that all competent evidence of rehabilitation will be considered upon re-application. <br /> <br /> <br />
