2.15 Smoking Policy: The City has prohibited smoking in all City Parks, Facilities and Buildings. This rule <br />must also apply to all contractors and workers in City buildings, grounds or parks. The Contractor shall be <br />responsible for the implementation and enforcement of this requirement on all public property. <br />2.16 Payments: Payment will be upon submittal of an invoice to The Ramsey Municipal Center on a net 30 <br />basis unless discount terms are offered. Invoices must include a purchase order number. <br />2.17 Force Majeure: The Contractor shall not be held liable if the failure to perform under this Contract arises <br />out of causes beyond the control of the Contractor. Cause may include but are not limited to, acts of nature, <br />fires, tornadoes, quarantine, and strikes other than by Contractor's employees. <br />SECTION THREE <br />3.0 PERFORMANCE TERMS AND CONDITIONS: <br />3.1 The Park Supervisor, Mark Riverblood is responsible for administering and managing the contract, and <br />he may assign a staff contact person for some of the day -to -day operations and he/ she therefore would be <br />responsible for the inspection of the specifications within the contract. <br />3.2 Employees: All persons employed to perform these services shall be employees of the Contractor, well - <br />trained in trash, cleaning and inspection procedures. The Contractor shall abide by all federal, state and local <br />laws, rules and regulations with regard to the employment of minors. The Contractor shall provide a <br />sufficient number of employees to perform the required services efficiently and in a manner satisfactory to <br />the City. If the Parks Supervisor notifies the Contractor in writing that any person employed on this contract <br />is incompetent, disorderly, or otherwise unsatisfactory, such person shall not again be employed in the <br />execution of this contract without the written consent from the City. Further, all persons performing the <br />tasks this RFP addresses on City property shall be fully competent in communicating in English with residents <br />and City staff. <br />Wage <br />
