Civil Engineer II Linton reviewed the staff report.

Councilmember Dehen asked if this was trying to rectify the problem to May 2009.

Civil Engineer II Linton responded that was correct.

Motion by Councilmember Dehen, seconded by Councilmember McGlone, to recommend to the
City Council changing the REU for 14000 Sunfish Lake Blvd to 16.062, 6451 McKinley Street
to 10.254 and 6250 Sunfish Lake Blvd to 20.927, effective May 2009 and credit these properties
for the 2nd Quarter and 3rd Quarter 2009 billing difference.

Motion carried. Voting Yes: Chairperson Elvig and Councilmembers Dehen and McGlone.
Voting No: None.

Case #3:

No Parking Restrictions on Public/Private Streets

Assistant City Engineer Jankowski reviewed the staff report.

Councilmember McGlone asked if there was a checklist staff used.

Public Works Director Olson responded it was always thought that the association agreement
would cover this, but the City did not have the opportunity to review the agreements. He noted
going forward, the City would review all association agreements.

City Engineer Himmer noted in the future escrow could be collected for signage.

Councilmember Dehen stated he was not a big believer in spending a lot of money on signage.
He believed things could be accomplished with letters to the associations.

Assistant City Engineer Jankowski stated the City could send out letters to the associations
asking for compliance and request the associations respond back and acknowledge the no
parking restrictions would be enforced and if the associations did not respond, the City would
install signs and charge for the signs and installation.

Public Works Director Olson noted public streets the City could signage with no problem, but on
the private streets he was not sure if the City could enforce signage.

City Administrator Ulrich believed the Fire Code was stronger than an association agreement
and if there was a safety issue, the Fire Marshall had broad sweeping powers.

Fire Chief Kapler suggested staff prepare maps to be given to the associations outlining their
developments.

Chairperson Elvig asked staff to prepare an estimate on how much it would cost to sign public
streets.

Public Works Committee / November 17, 2009
Page 4 ofS
