<br />Attachment D <br /> <br />Councilmember <br /> <br />" intr~ducedthe following resolution and moved for its adoption: <br /> <br />'RESOLUTION # <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A ' <br />REQUEST FROM EDDY'S AUTO & BODY REPAIR INC., TO ALLOW MOTOR <br />VEHICLE REPAIRS AND MOTOR VEIDCLE SALES AT THE PROPERTY <br />LOCATED AT 6845 IDGHWAY lO-NW. <br /> <br />'WHEREAS, Eddy's Auto & Body Repair, Inc., hereinafter referred to as the <br />"Applicant," has properly applied for a Conditional Use Permit to conduct motor vehicle repairs <br />and motor vehicle sales on the propertY generally known as 6845 Highway 10 NW and legally <br />described as follows: <br /> <br />That part of Lot 3 Auditors Subdivision No. 31 described as follows: Beginning at the' <br />southwest comer of said lot, thence southeasterly along southerly line of said lot 450 <br />feet, thence north parallel with west line thereof 385.04 feet to north line of said lot, <br />thence northwesterly along said northerly lii:1e 447.09 feet to northwest comer thereof, <br />thence south along west line of said lot to point of begiiming, subject to easement of <br />record, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY TIDS CITY COUNCIL OF, THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />, . <br />1. That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 117-51 of the Ramsey City Code on March 4, 2010, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br /> <br />2. That the Subject Property is zoned H-l Highway 10 Business District. Properties to the east <br />and west of the Subject Property are also zoned H-l Highway 10 Business District; south of <br />Highway 10 the properties are zoned MU-PUD (Mixed Use Planned Unit Development) and <br />consist of a mixture of residential townhome units and commercial businesses; north of the <br />railroad tracks the properties are ?:oned E-2 Employment District. <br /> <br />3. That the Subject PropertY is approximately 3.56 acres in size. <br /> <br />4. That City Code requires a conditional u~e permit within the H-l Highway l~ Business <br />District for motor vehicle repairs and motor vehicle~ales. ' <br /> <br />5. That motor vehicle sales is already. occurring on the Subject Property and is currently <br />considered to be a lawful nonconforming use. <br /> <br />7 <br />
