Within a reasonable time after the hearing, the Board of <br />Adjustment shall make its order deciding the matter and serve a copy <br />of such order upon the appellant or the petitioner by mail. If the <br />city council does not act as the Board of Adjustment, the Board of <br />Adjustment's decision may be appealed to the city council. The city <br />council, after review of the Board of Adjustment's minutes, records <br />and files, may affirm, reverse, or modify the Board of Adjustment's <br />action. If the city council acts as the Board of Adjustment, or after <br />the city council acts on a Board of Adjustment's decision, this shall <br />be the final action ot the city on the variance application. <br /> <br />170.019 <br />170.019A <br /> <br />N.lEI\.IDI"IT:NTS <br />AMEI'.JD!\IENTS <br /> <br />The city council may amend this chapter as proposed by a member of the <br />city council, by the planning commission, or by a petition of a person <br />residing or owning property within the City of Ramsey, in accordance <br />with the following provisions: <br /> <br />. <br /> <br />170.019B PROCtDURE <br /> <br />~. Petitions for amendment shall be filed with the planning <br />commission and the petitioner, upon such filing, shall pay an advertis- <br />ing deposit and a filing fee in accordance with a schedule annually <br />affixed by resolution. The planning commission shall review the pro- <br />posed amendment and report its findings and recommendations in writing <br />to the city council and to the petitioner. The proposed amendment <br />shall be introduced before the city council only if a member of the <br />city council elects to do so. If an amendment proposed by petition <br />is not introduced, the advertising depsoit shall be refunded to the <br />petitioner; otherwise such deposit shall be P?id to the city. <br /> <br />. <br /> <br />2. Any proposed amendment introduced -by a member of the <br />city council without written findings and recommendations from the <br />planning commission shall be referred to the planning commis~ion for <br />review at least thirty (30) days prior to public hearing by the council. <br />The city council may not act upon the proposed amendment until sixty <br />(60) days have elapsed from the date ot reference of the amendment <br />without a report from the planning commission. <br /> <br />3. Before voting on the enactment of an amendment, the city <br />council shall hold a public hearing thereon, pursuant to public notice. <br />It shall be the responSibility of the zoning officer to have notice of <br />the time, place, and purpose of the public hearing published in the <br />official city newspaper ten (10) days prior to the hearing. <br /> <br />Also~when.an.amendme.nt involves changes in district boundaries affect,.. <br />ing an area of five (5) acres or less, a written notice of the hearing <br />stating its time, place, and purpose shall be mailed by the zoning <br />officer at least ten (10) days before the day of the hearing to each <br />owner of affected property and property situated wholly or partly with- <br />in three hundred fifty (350) feet of the property to which the amend- <br />ment relates. For the purpose of giving mailed notice, "the zDning <br />
