Interim Use Permit was to remove the existing 1,500 square foot accessory structure <br />within nine (9) months of approval of the Permit. <br />5. That the Applicant is now requesting to permanently keep the existing 1,500 square foot <br />accessory structure. <br />6. That on November 18, 2009, the Applicant properly applied for a conditional use permit <br />(the "Permit") to exceed the amount of accessory structure square footage allowed by City <br />Code Section 9.11.02 by 1,280 square feet to allow the existing 1,500 square foot <br />accessory structure (the "Structure"), originally required to be removed per the Interim Use <br />Permit, to remain. <br />7. That the Subject Property and surrounding parcels are zoned R-1 Rural Developing. <br />8. That the Subject Property is approximately 9.3 acres in size. <br />9. That Section 9.11.02 of the Ramsey City Code states that on parcels of land of this size, <br />the total square footage of the main garage and all accessory buildings shall not exceed <br />5,100 square feet and that oversizing of accessory structures is a conditional use under <br />City Code Section 9.20.11. <br />10. That City Code Section 9.11.04 relating to home occupations states that the area set aside <br />for the home occupation in attached or detached accessory structures shall not exceed total <br />accessory building space or height allowed on the site of the home occupation, as <br />established in Section 9.11.02 of City Code. <br />11. That the Applicant currently has three accessory structures on the Subject Property. The <br />two accessory structures existing prior to the approval of the interim use permit total 1,980 <br />square feet. The New Structure totals 4,400 square foot. Total accessory structure square <br />footage is 6,380 square feet. <br />12. That the Structure appears to meet all applicable setbacks. <br />13. That the Subject Property is not expected to be included in the Metropolitan Urban <br />Service Area (MUSA) boundary in the near future. <br />14. That the proposed use will not adversely impact traffic in the area. <br />15. That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br />16.
