C. To SELLER's actual knowledge, there are no unrecorded leases, purchase <br />options, rights of first refusal, or any other unrecorded agreements which <br />grant any other party any right of use of occupancy in effect with respect <br />to the Property or any portion thereof. <br />d. To SELLER's actual knowledge, There are no management, <br />maintenance, supply, utility or service contracts relating to the Property <br />which will extend beyond the Closing Date, which are not cancelable <br />without penalty or premium upon not more than atdays advance notice. <br />e. To the best of SELLER'S knowledge: except as described in Section 7, <br />there is no action, litigation, investigatpo condemnation or proceeding of <br />any kind pending against SELLER or the Property- which could adversely <br />affect the Property, any portion there or title thereto <br />f. To SELLER's actual knowledge, no notice of hearing has been received <br />from any governmental assessing authority concerning a new public <br />improvement project the costs of which project may be assessed against <br />the Property. <br />g. All services or ma r al'°,which have been furnished to the Property have <br />been fully paid for or will be fully paid for prier to the Closing Date so <br />that no lien for services or materials rendered (commonly known as <br />mechanic's or materialsmen':s liens) .cwt be asserted against the Property. <br />All WM tP�E . sewer and rehse bins for`'such services which have been <br />finished tot the Property have been fully paid for or will be fully paid for <br />poor to the 'Closing Date so that no lien therefore can be asserted against <br />the :Property , <br />h. CONATION "OF PROPERTY: <br />(1) To 8ELLER's actual knowledge, there are no underground storage <br />tanks currently located on the Property and there has been no <br />methamphetamine production on or about any portion of the Property. <br />(2) BUYER acknowledges that the Property (i) has been used for the <br />distribution and storage of petroleum or petroleum products, (ii) <br />underground storage tanks have been used on the Property for the <br />storage of petroleum, and (iii) SELLER has caused to be removed all <br />petroleum storage tanks, dispensing equipment and petroleum lines on <br />the Property. <br />5 <br />
