App. Div. 2009) <br />NEW JERSEY (12/30/09)—This case addressed the following issue: <br />"whether a planning board has authority to grant an application for a site <br />plan approval for a development that is prohibited in the zoning district, by <br />conditioning the approval upon the applicant obtaining a use variance from <br />the board of adjustment or a change in the zoning of the development site." <br />The Background/Facts: Owen Properties, LLC owned a 9-acre tract (the <br />"Property") in the township. Owen contracted to sell the Property to Lib- <br />erty Square 517, LLC. Liberty planned to construct a shopping center on <br />the Property. Liberty sought approval from the township's planning board <br />(the "Board") for construction of the shopping center. Liberty sought that <br />approval based on a 1989 site plan approval (the "1989 Approval"). The <br />Board had given the 1989 Approval to the entity that owned the Property <br />prior to Owen ("Owen's predecessor in title").
