Councilmember Look introduced the following resolution and moved for its adoption: RESOLUTION #09-07-144 RESOLUTION APPROVING A CONTRACT WITH AN INTERESTED COUNCILMEMBER UNDER MINN. STAT. §471.88, SUBD. 5 §471.89, SUBD. 2 WHEREAS, the City of Ramsey (the "City") desires to purchase the following: Abatement services including blight clean-up classified as a nuisance by the City Code and as defined in the City's Request for Proposals for Nuisance Abatement Services dated May 29, 2009 (the "RFP"); and WHEREAS, the City desires to enter into an Abatement Services Contract (the "Contract") with a responsible contractor pursuant to the terms and conditions of the RFP; and WHEREAS, the City duly advertised for potential contractors to respond to the RFP; and WHEREAS, five (5) responses to the RFP were received by the City. Each of the responses was reviewed by the City Council on June 30, 2009, which five (5) responses are on file in the City offices and are public data; and WHEREAS, Contractor's and Consultants Inc. dba Remove-all, 16038 Jarvis street NE, Ramsey, MN, a Minnesota corporation ("Remove-All") has been selected by the City Council as a responsible qualified contractor capable of performing the Contract; and WHEREAS, Remove-All's principal shareholder, Managing Officer and President is Colin McGlone, who is a current Ramsey City Councilmember and a public officer as defined by Minn. Stat. §471.87; and WHEREAS, by virtue of his ownership interest in Remove-All, Colin McGlone will be financially interested in the Contract; and WHEREAS, it is determined that Remove-All's unit price proposal for the various components of the abatement services required is as low, or lower than the price at which the services can be obtained elsewhere at this time; and WHEREAS, the Contract is not one that required to be competitively bid NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Administrator is directed to enter into an Abatement Services Contract on behalf of the City with Remove-All, pursuant to the terms of the RFP and Remove-All's unit price proposal.
