the contested term. Commissioner Niska stated that the beginning of 4.5 says "not <br />standing for election. ,.. " so that could be the second half. Chairperson Deemer stated <br />that after the results of the primary pares down to two candidates and if the incumbent <br />candidate cannot serve, that ensures that only one person is running for that seat. Do we <br />want to deal with having only one person on the ballot? Mr. Goodrich stated he hated to <br />say contested term because we have never used that before. Maybe we could say <br />"balance of the vacant term ". <br />Amendment by Commissioner Frederick and seconded by Commissioner Field to amend <br />the language for the last line in 4.5.5.3 to read Notwithstanding Section 2.3.1 of this <br />Charter, which provides for a four year term for the mayor and councilmembers, the term <br />of the mayor and/or a councilmember elected pursuant to this subsection will be for the <br />remainder of the vacant term. <br />Amendment carried. All present voted in favor. <br />Motion carried. All present voted in favor. <br />Consensus of the Commission was that if there was not a 100% vote in favor of this <br />ordinance, that the Council should return it to the Commission with comments. <br />COMMITTEE INPUT <br />1) Schedule Date & Topic(s) for Future Meeting <br />Future Topics <br />City Attorney Goodrich recommended that at the next meeting, the Charter Commission <br />talk about a form for petitions in Chapter 8 and Chairperson Deemer's issue regarding the <br />primary. <br />Chairperson Deemer asked that Mr. Goodrich formulate that and the Charter will make a <br />case for it. This has to do with the language — next highest vote getter in the Primary <br />Election. <br />Mayor Ramsey suggested a subject for future topics could be the issue of the City <br />Manager versus City Administrator. That was changed in 2005 and has not yet taken <br />effect. He would ask that this Charter look at that and how the process was. It was a <br />recommendation to do a certain date and the Council changed that date. Mayor Ramsey <br />stated it is his opinion that this was done improperly. He asked that the Charter <br />Commission review the procedure and how that all went. He understood Council was <br />supposed to accept the Commissioner's recommendation. The Council did not accept it <br />as presented. <br />Commissioner Cleveland stated that she would like the Charter to make a statement on <br />what occurred at the Council meeting with regard to dismissal of a Commissioner.
