NOTE CITY COUNCIL MINUTES
The following Council minutes were noted:
1) City Council regular meeting minutes dated December 8, 2009
2) City Council regular meeting minutes dated January 12, 2010
PUBLIC HEARINGS/BOARD BUSINESS
Case #1: Public Hearing Continued — Request for a Variance to Construct a Detached
Accessory Building Nearer the Front Property Line than the Principal Structure at 5161
156 Lane
Public Hearing
Chairperson Van Scoy called the public hearing to order at 7:04 p.m.
Presentation
Associate Planner Gladhill presented the Staff Report for the continued public hearing.
Citizen Input
Raymond Renner, 6295 144 Avenue NW, stated they were required to put the well in its current
location by state regulations and is not sure how the trucks got in there. He continued there is no
way he would be able to get to the well if the accessory structure was in the recommended
location and believes this is a hardship. The rig is 45 feet long and will just barely make a city
cul -de -sac. It is difficult for them to get off road.
Discussion ensued regarding maintenance of a well, how often this would incur and reasons for
replacement of a well.
Chairperson Van Scoy questioned if the entire area blocked out on the certificate of survey was a
reasonable amount of space to reserve.
Mr. Renner stated that is the window of where we can put a well in, can't go too far east or north
or too close to the building; have to keep it away from sources of contamination.
Chairperson Van Scoy clarified that this is not necessarily what is recommended, but is what is
available based on setbacks, etc.
Mark Hilliard, 5161 156 Lane, the applicant, explained his certificate of survey drawing and
reasons why the location he chose is the best.
Motion by Board Member Cleveland, seconded by Board Member Hunt, to close the public
hearing.
Board of Adjustment/February 4, 2010
