Lebanon Hills Special Area Plan <br />3 -56 I Land Use Plan <br />conforming in terms of use and lot size (12,000 square feet or greater), the <br />one (1) Agriculturally zoned properties has a nonconforming lot area by <br />failing to meet the minimum five (5) acre lot size requirement. <br />Transportation <br />The Special Area properties are provided access via both private and City <br />streets. Four (4) of the properties are accessed via Carriage Hill Drive (a <br />private street with access to Pilot Knob Road), while one (1) is accessed via <br />120th Street West, a private road. <br />Vision <br />In recognition of the surrounding park use, the community envisions these <br />five (5) residential properties as part of the Lebanon Hills Regional Park. <br />However, the interim use of these properties as single family residential <br />homes does not negatively impact that vision. The City seeks to allow the <br />occupants of the residences to remain as conforming uses, while not allowing <br />any future subdivision. Thus, to achieve the required land use consistency <br />between the Land Use Plan and Zoning Map, the City has adopted policies <br />to guide the transition of the existing residential use to a future park use. <br />Land Use Designation <br />Recognizing that the purpose of the Land Use Guide Plan is to identify the <br />long -term desired use of property, all parcels in this Special Area have been <br />guided P, Parks and Recreational Open Space. <br />Land Use /Zoning Designation <br />While the land use plan and the zoning designation need to be consistent, <br />the City does not want to make these properties subject to the Zoning <br />Ordinance's nonconforming use requirements. In addition, the continued <br />use of these properties as single family homes is deemed consistent on an <br />interim basis. Thus, instead of the P, park zoning designation, which would <br />be consistent with the Land Use Plan, all of the properties will be zoned <br />R -1, Single Family Residential. Under the R -1 zoning designation, existing <br />homes will remain as "conforming" uses. Once the properties are acquired <br />by Dakota County the parcels should be rezoned to P -Park. <br />Policies <br />1. Existing residential uses are considered transitional in nature and their <br />continued existence shall be supported by the City on an interim basis, <br />provided they do not pose environmental concerns (i.e., failing septic <br />systems). <br />2008 Comprehensive Plan - Review Draft <br />
