Councilmember introduced the following resolution and mo <br />RESOLUTION #10 -02- <br />Attachment H <br />RESOLUTION AFFIRMING THE DESIGNATION OF 18055 ROANOKE STREET NW <br />AS PARK BASED ON THE CREATION OF A SPECIAL AREA PLAN ENABLING THE <br />ESTABLISHMENT OF AN OVERLAY DISTRICT ON THE OFFICAL ZONING MAP <br />AND MAINTAINING THE EXISTING, UNDERLYING ZONING <br />WHEREAS, the Metropolitan Land Planning Act (MPLA) requires local units of <br />government to submit comprehensive plans and plan amendments to the Metropolitan Council <br />for review and comment to ensure consistency with metropolitan system plans, consistency with <br />other adopted comprehensive plans of the Metropolitan Council, and compatibility with plans of <br />other local jurisdictions in the Metropolitan Area; and <br />WHEREAS, the Planning Commission held a Public Hearing on the 2030 <br />Comprehensive Plan Update (the "Update ") on November 26, 2008; and <br />WHEREAS, the Update includes the City's Tier II Comprehensive Sewer Plan; and <br />WHEREAS, on December 9, 2008, the City Council authorized distribution of the <br />Update for the required six (6) month review period; and <br />WHEREAS, the Metropolitan Council accepted the Update as complete on November <br />16, 2009; and <br />WHEREAS, on January 27, 2010, the Metropolitan Council authorized the City to put <br />the Update into effect, accepted the revised forecasts identified in the Review Record, advised <br />the City to implement the advisory comments in the Review Record for Land Use, Water Supply <br />and Plan Implementation; and <br />WHEREAS, on February 3, 2010, the City Council passed a resolution, contingent upon <br />approval of the property owner at 18055 Roanoke St NW (the "Subject Property ") of guiding the <br />Subject Property as Park; and <br />WHEREAS, on March 14, 2010, the City received a letter from the Subject Property <br />indicating the property owner was not supportive of guiding the Subject Property as Park; and <br />WHEREAS, the City finds that the Subject Property's interest in continuing to utilize the <br />Subject Property as a primary residence are protected by Minnesota Statute §462.357 Subd. le <br />and City Code §117-57 and finds that the creation of a special area plan created by an overlay <br />district on the Official Zoning Map will further protect the Subject Property while not negatively <br />impacting the vision for Rum River Central Park. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />
